CALLS FOR HELP IGNORED-ELDER ABUSE AND NEGLECT

ASSISTED LIVING FACILITIES ACROSS THE COUNTRY...ALL THE SAME...FOR PROFIT!  



The story below reminded me of issues related to our Dad's stay at Merrill Gardens Assisted Living Facility in Oceanside, California.  In this article from FOX 13, the lawyer for the family of the veteran who died states:  


 “The biggest problem to me is the attempt to cover it up,” said Michael Prieto, who represents the Dempsey family.  If they made a mistake then a person of integrity stands up and says I made mistake and you deal with the consequences that certainly hasn’t happened in this case,” Prieto said.


From all the stories that I have heard about and read about, as well as the story of  our Dad, these Assisted Living Facilities are for profit and have no integrity and will never admit they made any mistake.  They do everything they can to cover up any wrongdoing on their part.

DEKALB COUNTY, Ga.     Family of a World War II veteran is suing the Atlanta-based nursing home where he died.  They say a hidden camera, installed at Northeast Atlanta Health and Rehabilitation Center, shows the elderly man’s repeated calls for help were ignored.
Tim Demsey says his father, James Dempsey, was nervous about spending the night at the facility, so the family installed a nanny camera facing the man’s bed. Only his family and his father knew the camera existed, according to Dempsey.The family of the 89-year-old says he was supposed to be at the assisted living facility for a short time. He died at the facility in February 2014. “We would have just thought it was natural causes and everything was done that should have been done and he passed away in his sleep,” Dempsey told Channel 2’s Rachel Stockman. Dempsey says he got the real story when he took the hidden camera home and reviewed the video.  “Shock, dismay, we’ve seen these people everyday,” he said.
On six occasions in the video from the morning he died, Dempsey can be seen pressing the “call/help light button from his bed.” He can also be seen yelling, “help, help, help,” and appears to be pointing to his heart.  At one point a nurse on the video says, “you gotta stop putting the light on. What do you want now?”  A nurse also tells him, “you’re having anxiety that’s all, you just need to calm down.”
 “You would never thought that people would just let a person die,” Dempsey said.
About two hours after the initial call light, the nurses are seen administering CPR for several minutes and then the video shows the paramedics arriving – by then itis too late.
The son filed a lawsuit against the facility, which is owned by one of the largest nursing home operators in the country, Atlanta-based Sava Senior care.
 “The biggest problem to me is the attempt to cover it up,” said Michael Prieto, who represents the Dempsey family.

Since Monday, Channel 2 Action News has called the company and their attorneys for comment but have not heard back.

THE NAME GAME: MERRILL GARDENS


Merrill Gardens ... is always looking for a way to con the public in order to get more "heads in beds".  They  invented this name game...Facility name was Pacific Place a Merrill Gardens Community, but it had racked up some citations from the state licensing agency, the DSS.  No problem...changed the name to Merrill Gardens at Oceanside and 

....then there are no citations.  One day citations and the next day gone. MAGIC!  Depending on which day you ask to see the DSS records, you will see the place as no history of citations  or a lot of citations, which include actual deaths of residents due to their negligence.  Just changing the name...even under same ownership/management allows them to do this.  I have not seen other RCFE chains using this, only Merrill Gardens.  Merrill Gardens allegedly spent money to oppose allowing  DSS records to be posted online as well.  Now that this law passed and the DSS posts them, I understand that Merrill Gardens is now using a law firm and other means to dispute and try to get rid of  the citations that they started racking up AFTER  they were able to zero them out with the name change game.  

This is an intentional...beat the system tactic that Merrill Gardens uses. It is done so that potential residents will not see their bad record and decide to select another facility to call "home".

HAPPY HALLOWEEN MERRILL GARDENS


Every day is Halloween at Merrill  Gardens !

It has been awhile since my last update on Merrill Gardens...more to come.  Just looked quickly at the DSS reports and more of the same ongoing violations.  Nothing changes...medication errors, staff hitting residents, head injuries, unexplained bruises, and more. 

Our Dad was a ward of the San Diego Public Guardian and a resident of Merrill Gardens in Oceanside, a deadly combination...but a huge money maker for the probate court, attorneys, county agencies and of course the for profit Assisted Living facilities owned by Merrill Gardens.  

Nine months after being forced into Merrill Gardens and not allowed to leave, he was dead. During the 9 months he was in and out of ER for "unwitnessed falls" , head injuries, massive bruising and lacerations (NOTE: was not on blood thinning medication), severe dehydration, and more ($350,000).  He paid $6,000 per month for this lack of care and abuse.  





Merrill Gardens did nothing.  The Public Guardian did nothing.  Laughed all the way to the bank and on to the next victim.




More to come...updates on guardianships, assisted living , Public Guardians, for profit Private guardians, etc. This is not an isolated incident, it is happening all over the USA and other countries as well.  GREED...STEALING FROM THE ELDERLY AND NOT CARING FOR THEM OR ABOUT THEM.



I WOULD NOT RECOMMEND MERRILL GARDENS TO MY WORST ENEMY!

MERRILL GARDENS has their own standard of care.  So if you are thinking of moving into a Merrill Gardens facility you need to know what they consider meeting the standard of care so you can decide whether you want to live in one of their facilities.  

IF YOU LOOK LIKE THIS  (BELOW) AT LEAST 20 TIMES IN A NINE MONTH PERIOD AND SPEND MORE TIME IN THE HOSPITAL ER THAN YOU DO IN YOUR $6,000/MONTH SMALL ROOM WITH TORN CURTAINS, STAINED CARPET, NO BATHROOM AND VIEW OF A PARKING LOT... MERRILL GARDENS SAYS YOU MEET THE STANDARD OF CARE.
